Terms of Service

These Terms of Service govern your use of Site Layer Pro's GIS aggregation, conversion, and Civil 3D integration services.

1. Service Description

This application provides tools for selecting geographic areas of interest (AOI), accessing and aggregating geospatial data from third-party sources, transforming and converting such data (including via GDAL or similar tools), and delivering processed outputs for use in CAD and related environments.

2. Third-Party Data Sources

The Service does not create or own the underlying data. All such data is sourced from third-party providers, and all rights remain with the original data providers.

3. Data Use and Responsibility

You are solely responsible for determining whether your use of any data obtained through the Service complies with applicable laws, licenses, and terms imposed by the original data provider.

4. Transformation Disclaimer

The Service may convert, reproject, clip, or merge data. These transformations may alter the original data and do not guarantee accuracy, completeness, or consistency with the source.

5. Local Storage and Export

The Service may store or export data to local directories controlled by the user. Any exported data is under the user's control, and the Service assumes no responsibility for downstream use or redistribution.

6. Redistribution Warning

Exporting or saving data may constitute redistribution under applicable data provider terms. You are responsible for ensuring compliance with all licensing restrictions.

7. API and Access Behavior

The Service may access or interact with third-party APIs or systems to retrieve data. The Service does not guarantee that such access complies with any upstream provider's intended use policies. Users are responsible for ensuring compliance with the terms of the applicable data source.

8. Prohibited Use

Users may not use the Service to systematically extract, replicate, or reproduce substantial portions of third-party datasets in a manner that circumvents intended use or licensing restrictions.

9. No Warranty

ALL DATA AND OUTPUTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, INCLUDING ACCURACY OR FITNESS FOR A PARTICULAR PURPOSE.

10. No Reliance

The Service is not intended for engineering, surveying, or legal determinations. Users must independently verify all data.

11. Limitation of Liability

To the fullest extent permitted by law, the Service is not liable for errors, misuse of data, or damages arising from use. Liability is limited to $0 or fees paid in the past 12 months.

12. Intended Use

The Service is intended for facilitating user-directed access to publicly available data and is not intended as a data distribution or harvesting system.

13. Indemnification

You agree to indemnify and hold harmless the Service provider from claims arising from your use of data or violation of third-party terms.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania.
